Even though the APSCTQ makes all reasonable efforts possible to ensure the accuracy of the information and documents on its Site, the Site and the elements on it are provided as is, without any warranty of any type, express or implied. The APSCTQ, as well as the Toyota Dealers Association of Quebec, the Quebec Toyota dealers, Toyota Canada Inc., their affiliated or related companies, their members, shareholders, administrators, directors, employees, service suppliers, advertising agencies, agents and representatives (the “Beneficiaries”) cannot in any case be liable for any damages directly or indirectly arising from the use of this Site and/or its contents.

The APSCTQ in no way guarantees that the Site will be accessible or functional without interruption, or that its content is free of viruses, defects, harmful elements, or any other errors or materially damaging components. The APSCTQ and the Beneficiaries disclaim all liability of any kind whatsoever related to the malfunction of any computer or software components, or any communication lines, related to the loss or absence of a communication network, or related to any faulty, incomplete, incomprehensible or erased transmission by any computer or network that could limit or prevent any person from accessing the Site or one of its features. The APSCTQ and the Beneficiaries disclaim all liability of any kind whatsoever for damage or loss that may be caused, directly, or indirectly, in whole or in part, by downloading web pages, software, or by the transmission of any information related to navigating on this Site.

The APSCTQ and the Beneficiaries shall in no event be liable for any direct, indirect, special, incidental, punitive, or exemplary damages whatsoever (including and not limited to loss of profits or revenue, non-fulfilment of anticipated savings, business interruption, or any other pecuniary or economic loss arising out of the use or the inability to use this Site, even if the APSCTQ and the Beneficiaries were informed of the possibility of such damages or could reasonably foresee the occurrence of such damages.

Only certain Toyota dealers participate in the My Toyota Extra Program. Site users recognize that it is their responsibility to verify whether or not a particular dealer participates in the Program and releases the APSCTQ and the Beneficiaries from any liability of any kind whatsoever in this regard. The APSCTQ can from time to time display special offers that are not valid at all participating Quebec dealers. Information of this nature is provided for information purposes only. In the case of differences between My Toyota Extra Program special offers as presented at participating dealers and those shown on this Site, the information concerning the special offers presented on this Site shall prevail.The APSCTQ makes no warrant of any kind, either express or implied, regarding Toyota vehicles, products and services.

The content of the Site is protected by the Copyright Act and The Trade-marks Act, as well as any applicable international conventions. Unless indicated otherwise on the Site or herein, it is forbidden to copy, reproduce, distribute, publish, translate, download, upload, display, or transmit in any manner whatsoever any element of this Site, including but not limited to its content, data, texts, images, video and audio excerpts, codes and software, without the prior written consent of the APSCTQ. However, it is permitted to display, to conserve in memory, to download, or to print all of the Site’s contents for personal use only, provided that it is not modified. It is not permitted in any case to use the content of this Site to suggest an association with the APSCTQ, Toyota Dealers Association of Quebec, Toyota Canada Inc., or any other entity that is related or affiliated with these entities.

The APSCTQ reserves the right at any time without notice to suspend or cancel at its sole discretion the profile of a Site user. The APSCTQ also reserves the right to restrict in whole or in part the access of a Site user. Neither the APSCTQ, nor les Beneficiaries can be held liable in any way whatsoever for such a suspension, cancelation or restriction.

The laws of Quebec and Canada govern the use of this Site regardless of your place of residence or your location. You accept and hereby submit to the exclusive jurisdiction of the Quebec courts with respect to any dispute concerning access and use of this Site.

The failure of the APSCTQ, its successors and assigns to assert or enforce any right or provision of these conditions of use shall not constitute a waiver of such right or provision. Should any portion of theses conditions of use be declared null or void, this shall in no way affect the validity of the remaining provisions contained herein.
